A call to order of the fifth meeting of the Board of Governors of Asbestos Textile Institute, Inc., was issued by Chairman Scanlan at 3:15 p.m., February 3, 1977. 2. READING OF MINUTES. Upon Chairman Scanlan calling for a read ing of the Minutes of the last stated meeting, a motion was made by Mr. Bratt to dispense with the reading thereof. The motion was seconded by Mr. Pilmer and so carried unanimously. 3. FINANCIAL REPORT. The six-page Report of Funds as of December 31, 1976 (See Attachment I) was presented by Treasurer Corson. The cash balance at the beginning of the fiscal year, September 1, 1976, was $8403.13. During the four-month period to 12/31/76 total cash receipts were $13,689.01, and total cash disbursements were $4533.83 for regular expenses, $257.90 for exchange items and $3158.77 for ATI, Inc., litigation defense, leaving a cash balance on hand of $14,141.64. Considering assets and liabilities, actual net worth at 12/31/76 was $15,099.05. The expenses vs. budget picture shows about half that budgeted has been expended during the first third of the year, primarily due to extraordinary litigation expenses which were not included in the approved budget. This matter was discussed later in the meeting. Sales of the Chrysotile Asbestos Test Manual, 3rd edition, continue at a goodly pace and net revenue to date is $361.30. It was moved by Mr. Hay, seconded by Mr. Scowcroft, and so carried to accept the report as presented by the Treasurer. The Report of Funds will be filed for audit. . SOCIAL. Chairman Scanlan read to the Governors the following note from Millie Griffis, wife of the late Jesse T. Griffis: "Thank you so much for your gift to Heinemann Research for Jesse. A wonderful tribute to a man who spent so many years working in the asbestos field and for ATI. All our family appreciate your caring." 5_. MESSAGE FROM AIA/NA. R. H. Mereness, Executive Director of the Asbestos Information Association/North America sent the following message to the Board via Chairman Scanlan. AIA/NA has embarked on a new program to open its membership to a broader spectrum of the Industry. The feeling is that the entire Asbestos Industry must be involved in the association's work, both financially and by provid ing expertise. Mr. Mereness alerted the Governors to the new Cancer Policy pro posed by the U.S. Occupational Safety and Health Administration. OSHA has proposed to categorize toxic materials into one of three areas: known carcinogens, suspected carcinogens or neither. Included in OSHA's definition of carcinogens is "no acceptable level of worker exposure; exposure must be the lowest detectable level." The proposal is currently in the hands of the Subgroup on Standards of the National Advisory Committee on Occupational Safety and Health. MS 006800 more MT-006205 ATI-140 Page 3 - ATI Inc. The Secretary announced that finally all desired information is at hand for the new Membership Directory and that the publication is now ready for the printer. In an effort to save postage and packaging costs, the Directory will be mailed with the next membership mailing, 7_. MEMBERSHIP. Mr. Pilmer mentioned to the Board that although Garlock of Canada Ltd. is the Regular Member of ATI, Inc., its majority-owned "Amiante de Sherbrooke Ltee" will also be sending representatives to meetings on behalf of Garlock. 8. FRIENDS IN ASBESTOS CLUB. Mr. G. Gindre, President of FinAC, had submitted to ATI, Inc., the provisional Statutes for its con sideration in becoming a Member of the newly-established organiza tion. Before making a final decision, the Secretary was directed to ask Mr. Gindre for a membership list of the Club. 9. FUTURE MEETINGS & SCHEDULES. Mr. Hay expressed pleasure with the new two-day meeting schedule. He said the slight alteration in times set for each meeting resulted in his saving considerable time and expense. Chairman Scanlan announced that W. H. Smith had approached him about ATI, Inc., holding a meeting in Canada. Following discussion, it was agreed to consider June 1979 as a suitable time to meet that far North. Chairman Scanlan will further review the matter with Mr. Smith and will report back to the Board at the next meeting. Mr. Barois offered Mexico as a possible future meeting site, stating that February is an ideal month, weather-wise. The Chairman then announced the following dates and places for future meetings: 1977 Jun 2-3 - Capitol Hilton, Washington, D.C. 1977 Oct 5-7 - Ponte Vedra Club, Ponte Vedra Beach, Florida 1978 Feb 1-2 - Terrace Garden Inn, Atlanta, Georgia 1978 Jun 1-2 - Washington, D.C. 1978 Oct 4-6 - Kiawah Island Inn, Charleston, South Carolina 1979 Jun - Thetford Mines, Quebec, Canada (tentative) In the future - Perhaps Mexico 10. ARTICLES OF INCORPORATION/AMENDMENT/BY-LAWS. The Secretary an nounced that as soon as the Commonwealth of Pennsylvania approves the filing of the Articles of Amendment, said amendment will be published in the Legal Intelligencer and printed Articles and By Laws will be made available to the membership. The following section was added to the By-Laws following a motion by Mr. Pilmer, seconded by Mr. Corson, and so approved, unanimously: "SECTION 12--VOTE BY MAIL. A vote by mail may be taken when deemed advisable and a majority vote of the members of the Board of Governors may pass a motion or resolution. Exception: When a vote to revise the By-Laws is taken by mail, a two-thirds vote of the members of the Board of Governors is required to amend said By-Laws." Kennedy, RaybestosManhattan, Inc. The agenda for the Committee Meeting to be held the next morning included a continuation of the review and discussion of the proposal submitted by FRL/An Albany International Company, via its Assistant Director Dr. S. Golub, to develop an improved sampling and counting technique for airborne asbestos fibers. Although the proposal would not be sufficiently beneficial for Raybestos Manhattan Industrial Products Company to undertake the project by itself, it would be willing, in the interest of trying to advance the state of the art,, to contribute financially if other firms showed similar interest. A copy of the three-page policy adopted by RMIPCo is appended hereto as Attachment II. Mr. Kennedy advised the Governors that RMIPCo would like to be come involved in an endeavor to better the method of fiber counting. It is not being suggested as a project of ATI, Inc., but rather taking advantage of ATI, Inc., by perhaps utilizing it not as a sponsor but as a mothering organization. RMIPCo is willing to share the responsibility of such an endeavor, provided other companies are sufficiently interested in participating. Also to be discussed by the Committee was ANSI Standard Z88-2/1969 on Practices for Respiratory Protection, housekeeping practices in the workplace and the booklets "Method for Determining Asbestos Dust Concentrations" and "Measurement of Airborne Asbestos Fiber by the Membrane Filter Method." b) Technical -- Report by Chairman A. R. Morrill, Canadian JohnsManville Co. Ltd. All ASTM Specifications relating to asbestos textiles are current and the next to be reviewed for possible revi sion will not be due for two years. At its meeting scheduled for the next day, the Committee will give extensive time and study toward determining the best approach to take in revising the Handbook of Asbestos Textiles, 3rd edition, printed in 1967. Meanwhile the Secretary has been requested to search the files to determine how many copies of the 3rd edition were printed and at what cost. c) Fiber Research & Testing -- Report by Chairman H. R. A. Devriese. Asbestos Corporation Ltd. Mr. G. F. A. Brink, liaison between the Quebec Asbestos Mining Association and ATI, Inc., has informed the Committee that an updating is necessary to 20 pages of the Chrysotile Asbestos Test Manual, 3rd edition, printed in 1974. By the next meeting the Committee will have the revisions at hand, giving it opportunity to review and offer comment. In the meantime the Secretary will check the records to locate former press run data and how many copies of the Manual have been sold to date. Price quotations for printing the revised tests will be sought at the proper time. The Round Robin test program on fiber counting is still in pro gress. Findings are anticipated by the June meeting. At its meeting the next morning, the Committee will discuss an abbreviated Suter-Webb test method for measuring fiber length and textile fibers. MS 006802 WIT-006207 more ATI-140 Page 5 - ATI Inc. Board of Governors Meeting - 2/3/7 7 Also to be considered is the Bauer-McNett classifier, comparing the effectiveness of the four-tank and the five-tank models insofar as fiber binding at the first screen is concerned. Perhaps a Round Robin will be initiated in this connection. A program has been started using sedimentation to measure fiber diameters and average length. Further details are expected by the June meeting. Ms 006803 13. STATISTICAL COMPARABILITY UNDER U.S. TARIFF ACT. Chairman Scanlan announced the U.S. Bureau of the Census has requested voluntary comments from ATI, Inc., to one of a series of preliminary drafts of parts of an enumeration of articles which will provide for compara bility among U.S. import, production and export data. The Board agreed that ATI, Inc., as an organization, is not equipped to com ment but that it should be suggested to the Bureau that it contact each U.S. asbestos textile manufacturer on an individual basis. The Secretary will so advise the Bureau. 14. CARUSO REPORTS. Chairman Scanlan brought for discussion the subject of the inadequacy of the Caruso Reports as they now stand, primarily because there are only three U.S. asbestos textile produ cers who participate as Regular Members of ATI, Inc. After a com plete review, the Board unanimously agreed to continue with the reports but to expand the activity by asking all eleven Regular Member companies to participate. Doing so would make information available as to a larger percentage of the North American market for asbestos textiles. The Secretary was instructed to issue a memorandum to each Regular Member company, fully explaining the project and inviting each Governor to review the matter with his company and to be prepared to fully discuss and cast his formal vote at the June meeting of the Board. ASBESTOS HEALTH HAZARDS COMPENSATION ACT. On January 27, 1977, Johns-Manville Corporation hosted a meeting of representatives of the U.S. Asbestos Industry to explore the possibility of a legisla tive approach to the problem of third party litigation. Mr. Bratt reviewed the subject of possible responsible legislation as discuss ed at the meeting. 19. ADJOURNMENT. Kennedy A meeting was held at 9:00 a.m. on January 17, 1977 to discuss Dr. Golub's FRL Research Proposal for determining air borne asbestos dust concentration. Considerable time was spent discussing the value of this proposal relative to the present technique currently available for determining asbestos dust levels. Basically, the proposal consists of locating selective dyestuffs that will be absorbed only on the asbestos so that it will show up differently from other non-asbestos materials when viewed under a microscope. Generally, there are two main sources of error in the present membrane counting procedure for determining asbestos concentration. They arise from the relatively subjective manner in which the following two factors are determined: 1. Fiber Length (The individual conducting the test must visually decide which fibers are of the proper length to be counted in the test samples.) 2. Dust Composition (The individual must judge which fibers are asbestos and which fibers are not asbestos.) Dr. Golub's proposal (i.e. dyeing the asbestos fiber) stands to improve the test procedure only in the second above two areas. Burn-out tests conducted by our laboratories indicate that, typically, our level of non-asbestos particulate matter is very low, that is, in the range of 5 to 10 percent. Consequently, if Dr. Golub's technique improved our accuracy in that area about 50 percent,it would only mean a five percent improvement in our overall ability to specifically determine asbestos dust levels. In view of our concensus with respect to the value of Dr. Golub's proposal to RMEFCO and other asbestos textile yarn producers, Mr. Ferrucci outlined .our position as follows: 1. Conceptually, RMIPCO is not at all opposed to spending $10,000, or considerably more, if it ' would advance the state of the art of accurately and reproducibly determining air borne asbestos dust levels. 2. Although Dr. Golub's procedure appears to represent an improvement to the membrane technique presently used, it is only of minimum value to RMIPCO (i.e. only improving our accuracy approximately five percent). . 3. RMIPCO's interest notwithstanding, if the rest of our industry were to support this proposal, we would also support it to a lesser degree (e.g. $4,000 to $5,000) to -show our interest in advancing the state of the art. . 4. Testing techniques for accurately determining air borne asbestos dust levels are of great interest to us, and RMIPCO would actively support any meaningful program, domestically or inter nationally, that would help our industry monitor its "clean-up" operations. 5. Whatever activity is undertaken, it is strongly recommended that this be conducted directly by the concerned companies as opposed to going through any of the trade or industry association. A call to order of the sixth meeting of the Board of Governors of Asbestos Textile Institute, Inc., was issued by Chairman Scanlan at 3:15 p.m., June 2, 1977. 2. BOARD REPRESENTATION. .Chairman Scanlan officially welcomed Mr. Guffey as a new Governor, representing Garlock of Canada Ltd. and its majority-owned Amiante de Sherbrooke Ltee. The Chairman then read a communique from Harry M. Hay, a Member of the Board representing Canadian Johns-Manville Co. Ltd. Mr. Hay expressed apologies for being unable to attend the meeting, his participation having been pre-empted by a command to report for jury duty. 3. MINUTES OF LAST STATED MEETING. Upon Chairman Scanlan calling ror a reading of the Minutes of the last stated meeting, a motion was made by Mr. Bratt to dispense with the reading thereof. The motion was seconded by Mr. Corson and so carried unanimously. 4_. FINANCIAL REPORT. The six-page Report of Funds as of April 30, 1977, (see Attachment I) was presented by Treasurer Corson. The cash balance at the beginning of the fiscal year, September 1, 1976, was $8,403.13. During the eight-month period to April 30, 1977, total cash receipts were $30,329.60 and total cash disburse ments were $9,732.02 for regular expenses, $356.22 for exchange items and $12,364.45 for ATI, Inc., litigation defense, leaving a cash balance on hand of $7,876.91. Considering assets and liabi lities, actual net worth at April 30, 1977, was $7,885,90. The expenses vs. budget situation is healthy insofar as regularly budgeted items are concerned but when unanticipated, and therefore un-udgeted, litigation expenses are taken into account, the picture shows an expense figure about $500.00 over the budget total and about $5500.00 over actual receipts for the year to date. . Sales of the Chrysotile Asbestos Test Manual, 3rd Edition, con tinue at a goodly Dace and net revenue as of April 30, 1977, was $502.07. ` It was moved by Mr. Scowcroft, seconded by Mr. Bratt, and so carried unanimously to accept the report as presented. The Report will be filed for audit. MS 006817 5_. CORPORATE LITIGATION DEFENSE FUND. The Treasurer presented Attachment II to the Board of Governors to explain the status of the Corporate Litigation Defense Fund which was established via approval of the Governors on February 3, 1977 (See Minutes of Board of Governors Meeting, February 3, 1977, Item #16). As of May 31, 1977, $8,370.00 was received via Special Assessments and voluntary contributions out of a possible $11,750.00. Receipts less expenditures resulted in a minus balance of $4,013.45. 6_,, FRIENDS IN ASBESTOS CLUB. At the direction of the Board, the Secretary wrote Mr. G. Mr. Gindre replied that results thus far were not encouraging but if the situation changes he will so inform us. r 1_. FUTURE MEETING SITES & DATES. After a discussion on suitable places to hold future meetings, Mr. Guffey offered to send to the Secretary information on the Bay Hill Club & Lodge in Orlando, Florida, and Stonebridge Inn and Conference Center in Snowmass Village, Colorado (outside of Denver). Also, Mr. Barois volun teered to supply data on hotels in Mexico. CARUSO REPORTS. The discussion continued on increasing the value of the Caruso Reports by obtaining data from all eleven Regular Member companies. Since the quarterly statistical reports will show total retail sales of asbestos goods sold as textiles to the United States market, it was felt they would be an invaluable picture of the current market and market trends. The U.S. Regular Member companies agreed on the desirability of expanding the number of companies participating, but the four Regular Member Companies represented at the meeting who are headquartered outside of the U.S. expressed reservations about the value of the program if all of the Regular Member companies did not participate. After discussion, it was agreed the figures would be worthwhile if at least a large percentage of the manufacturers agreed to participate, since the data would show maybe 80%-90% of the total U.S. asbestos textile market. A copy of the quarterly reports will only be sent to those companies who submit figures. Due to the problems in preserving the confidentiality of each firm's market share, no company will be permitted to join the endeavor once the new program is in effect and the first report is issued. The hope was expressed that the expanded reports would begin with the fourth quarter of 1977. The Secretary will so advise all Regular Member com panies and request their affirmative response. A list of all individual comments received is to be sent to each Governpr. 9. ASBESTOS HEALTH HAZARDS COMPENSATION ACT. Governor Bratt reported on the current status of the Asbestos Health Hazards Compensation Act which is now in its eighth draft. Although there is no timetable for likely introduction, it is possible Rep. Board of Governors Meeting - S/2/11 Congress -- and reintroduce the Bill during the next session, firs. Fenwick has obtained a public co-sponsor of the-Bill, i.e., Rep. Beard, who is a member of the painter's' union. It was felt that Legal Counsel could keep the Governors abreast of the situa tion in the future. -. 10.. COMMITTEE REPORTS & DISCUSSIONS. . a) Technical -- Report by Chairman A. R. Morrill, Canadian Johns-Manville Co. Ltd. At the request of the American Society for Testing and Materials, the Committee is reviewing ASTM Speci fications D-299 on Asbestos Cloth and D-375 on Asbestos Roving. A discussion was held on a request from the American Textile Manufacturers Institute concerning the change to metric measure ment as it relates to the textile industry. It was unanimously agreed that the ATI Executive Secretary should respond that this conversion activity should be conducted through ASTM and its CommitteeD-13 on Textiles which includes Subcommittee D13.14 on Asbestos Textiles. Committee Chairman Morrill asked the 3oard for advice as to whether or not the ATI wished to finance a revision of the Hand book of Asbestos Textiles, 3rd Edition. It was agreed by the Governors that due to extraordinary litigation expenses, discus sion of the project should be tabled until the next meeting. Meanwhile Mr. Morrill will alert Legal Counsel as to which sec tions of the Handbook are definitely out-of-date after which Legal Counsel will prepare a pertinent statement of disclaimer for hand-insertion in each remaining issue of the Handbook in stock at ATI, Inc., headquarters. In addition, the member companies would receive similar information. It:was moved by Mr. Bratt, seconded by Mr. Scowcroft, and so carried unanimously that no further copies of the Handbook should be distributed until Legal Counsel has drafted a suitable disclaimer which should be enclosed in all copies of the Handbook sent out in the future. b) Fiber Research & Testing -- Report by Chairman H. R. A. Devriese, Asbestos Corporation Ltd. Approximately 20 pages of the Chrysotile Asbestos Test Manual, 3rd Edition, are in need of revision. The reviwed Tests have been approved by the Quebec Asbestos Mining Association members and are now ready for review by pertinent ATI members. V7hen finalized, price quotations will be sought from printers in the U.S. and Canada. A total antici pated expense sheet and method of handling should be ready for presentation at the October 1977 meeting of the Board of Governors. Further information on the Round Robin test program on fiber counting should be available at the next meeting. The discussion will continue on comparing the Suter-Webb method with a technique by Mr. J. P. Wronski, of Raybestos*- Manhattan, Inc., with the hope of determining fiber length more rapidly. The comparison of other methods will also be considered. The appeal was again made for more manufacturing members to serve on the Committee. c) Environmental -- Report by Chairman C. A. Kennedy, Raybestos-Manhattan, Inc. The Committee is scheduled to review the following items: the Dust Measurement and Control Seminar held the previous day; comments issued by the National Bureau of Stan dards on fiber content in industrial talc; and other occupational health issues such as housekeeping procedures followed at various asbestos textile manufacturing operations. 11. HARMONIZED COMMODITY DESCRIPTION & CODING SYSTEM. The Secre tary received a memorandum from Mr. J. H. Marsh, of RaybestosManhattan, Inc., asking if ATI, Inc., wanted to forward any com ments on the Harmonized Commodity Description & Coding System for use in the European Economic Community. Legal Counsel cautioned that the Governors should thoroughly discuss the matter to ascertain if ATI wished to become involved in the submitting of such information to the European organization. It was also suggested that we inquire whether the Customs Cooperation Council has any stated procedure governing the filing of comments. Since the Governors were not familiar with the System, Mr. Scowcroft was asked to secure more data from Mr. Marsh and report back to the 3oard at the next meeting. 12. REQUEST FROM BARRY I. CASTLEMAN. Mr. Castleman, an Environ mental Consultant headquartered in Washington, D.C., wrote the Institute expressing concern over the rising quantity of asbestos textile imports into the U.S. and offering to discuss with ATI members the problem of competition from "unregulating" countries. Following complete-discussion it was moved by Mr. Guffey, seconded by Mr. Scowcroft, and so carried unanimously, to write MR. Castleman and invite him to make a 10-minute presentation to the Board of Governors at the regularly-scheduled meeting of the 3oara on October 5, 1977. The motion included instructions to the Secretary to inform Mr. Castleman that, unfortunately, due to extremely heavy work schedules, limited available time and the way ATI meetings are set up, this would be all the time that could be scheduled for his presentation. He is to be further advised that after the member companies have had the opportunity to hear him, they will then be in position to contact him, individually, to discuss specific problems and issues. 13. OFFER FROM ROSSNAGEL & ASSOCIATES, INC. Chairman Scanlan presented a letter from W. B. Rossnagel, President of Rossnagel & Associates, Inc., in/which he offered to present a paper on the "True Story of the New Jersey School Asbestos Problem" and up-date the results of the asbestos ceiling situation in that State. SORES-LITTLE STUDY,FOR QAMA. Mr. Guffey informed the Governors that QAMA has awarded a contract to Sores, Inc., and Arthur D. Little Co., Inc., to undertake a study of the current and potential asbestos products market. He asked, on behalf of QAMA, if ATI would be willing to participate in an in-depth interview by the researchers. The Governors concurred that QAMA's interests would best be served if the ATI Secretary, when approached, would submit a list of member companies of the Institute so that personal con tacts could be made with each company. The motion was approved, unanimously. - 3. FINANCIAL REPORT. Chairman Scanlan presented the financial picture of the Tyler Litigation Defense Fund as of April 30, 1977. The case balance on hand at the end of the eight months of the fiscal year was $4,131.82. It was moved by Mr. Bratt, seconded, by Mr. Scowcroft, and so approved, to accept the report as presented. INTRODUCTIONS & OFFICLAL WELCOME. President Scanlan welcomed all in attendance, asking each attendee to rise and give his or her name and business affiliation. Upon calling for a reading of the Minutes of the last stated meeting, it was moved by Mr. Leclerc, seconded by Mr. Stiefken, and unanimously approved, to dispense with the reading thereof. 4, FINANCIAL REPORT. A report on the financial posture of ATI, Inc., at April 30, 1977, was presented by Treasurer Corson. Total cash on hand at September 1, 1976, the beginning of the 1976-77 fiscal year, was $8,403.13. For the first eight months of the current yearly period, receipts totaled $21,926.47, dis bursements reached $22,452.69, total assets were $7,986.99 and total liabilities amounted to $101.09, leaving an actual net worth at April 30, 1977, of $7,885*90. To date, sales of the Chrysotile Asbestos Test Manual, 3rd Edition, have resulted in a PRODUCED M -83 MS 006835 more..... Excluding exchange items and Corporate litigation expenses, disbursements totaled $9,732.02 for the eight months against the budgeted expense figure for the year of $16,950c00. A copy of the 3-page Report of Funds as of April 30, 1977, is appended hereto a3 Attachment I. Treasurer Corson then issued his report on the Corporate Liti gation Defense Fund as of May 31, 1977, Following a special assessment and appeal for voluntary contributions, an income of $8,370,00 was realized against a possible income of $11,750.00. Expenses against income resulted in a minus balance on May 31, 1977, of $4,013.45. Those member companies who had not contribut ed thus far were urged to do so as soon as possible. A copy of the one-page Corporate Litigation Defense Fund Report is appended hereto as Attachment II. _5. GOVERNMENTAL REGULATION. A briefing on various governmental issues pertaining to the .Asbestos Industry was given by Mr. Mereness. The change in the Administration has resulted in new personnel and priorities and more involvement in consumer and environmental affairs. Much more will bo seen in the coming months on the issues involved with asbestos. The members were reminded that Occupational Safety and Health Administration has proposed a 0.5 fiber per cubic centimeter of air asbestos manufacturing standard and National Institute of Occupational Safety and Health has stated this is not satisfactory and recommended an exposure limitation of 0.1 f/cc. There is currently no action taking place within OSHA which would lead us to believe that a date for a hearing has been set. The CONSAD report is now in its sixth draft and is being read interdepart mentally and by other interested agencies. Commensurate with the asbestos manufacturing standard is the asbestos construction standard. Both of these issues will bo combined in one hearing. Concerning the construction standard. Research Triangle Institute is preparing the economic analysis. The draft has been submitted to but not accepted by OSHA. Fur ther, a proposal has not been written for an asbestos standard for the construction industry. An in-depth study of the asbestos construction industry has been commissioned by AIA/NA. Equitable Environmental Health, Inc., has completed the study up to the point of relating it to what OSHA comes up with in its proposal. A workshop concerning asbestos and talc will take place July 16-18, 1977, at the National Bureau of Standards in Gaithersburg, Maryland. The meeting will be extremely important and will be international in scope. Other more brief information was given on the asbestos-related activities of the Environmental Protection Agency, the Consumer PRODUCED JM - 83 ...... AIA/NA is working diligently on its legal-medical affairs activity. Cadwalader, Wickersham & Taft has developed for the association an information bank on all the asbestos litigation. The service is available to all in the Asbestos Industry, not just to AIA/NA members. Part of the work is a search of the medical literature related to asbestos and health. 6. FIBER PRODUCERS REPORT. Mr. Reis presented a report on behalf of the fiber producing member companies of ATI, Inc., discussing QAMA and Cassiar fiber shipments for the first four months of 1977, inventories of and demand for various fiber Groups and other re lated matters. The entire report is appended hereto as Attachment III. 7. REPORT OF TECHNICAL COMMITTEE. Chairman Morrill reported on the status of the Committee's work on ASTM standards and specifi cations, asked for good attendance at the meeting of ASTM Subcom mittee C-13.14 on Asbestos Textiles on October 25, 1977, in New York City and announced that a decision to update the Handbook of Asbestos Textiles, 3rd Edition, will be held in abeyance for the time being. The entire report is appended hereto as Attachment IV. 8. REPORT OF FIBER RESEARCH & TESTING COMMITTEE. Chairman Devriese reported a good attendance at the meeting of the Committee that morning, stating the group discussed much of its activities as the dust count survey, revisions to the Chrysotile Asbestos Test Manual, 3rd Edition, comparing the Suter-Webb technique with an improved length measurement method of Mr, J. P. Uronski and other like developments. The entire report is appended hereto as Attachment V. 9. REPORT OF ENVIRONMENTAL COMMITTEE. Chairman Kennedy briefly reviewed the topics covered on June 1 at the Dust Measurement and Control Seminar and reported that the Committee, that morning, had discussed various subjects concerned with occupational health and safety as it relates to the asbestos industry. CORPORATE LITIGATION REPORT* Attorney Officer reported that the Corporation has been nonsuited from two lav/suits in Virginia but remains a defendant in three in Virginia, six in Philadelphia and one in Chester, Pennsylvania. It is expected that the ATI, Inc., Executive Secretary will be subpoenaed in order to got copies of the organization's Minutes of past meetings into the court records. Once that has been accomplished, plaintiffs* attorney has indicated ATI, Inc., will be dismissed or nonsuited from all of the pertinent cases in Virginia and Pennsylvania. 11. 1977 ANNUAL MEETING. President Scanlan advised the general membership that the 1977 Annual Meeting of ATI, Inc,, will be held October 5-7, 1977, at Ponte Vedra Club, Ponte Vedra Beach, Florida, just off the coast of Jacksonville. Meetings in 1978 will include February 1-2 at the Terrace Garden Inn, Atlanta, Georgia; June 7-9, 1978, in Quebec City; and October 4-6 at Kiawah Island Inn, Charleston, South Carolina, 12. F. Reis*at the 1977 Spring General Meeting of the Asbestos Textile Institute, Inc., held at the Capital Hilton Hotel, Washington, D.C., June 3, 1977. For the first four months of 1977 QAMA fiber shipments totaled 421,493 short tons. This represents a 4.5% decline from the 1976 total of 441,017 tons. Shipments of Group 3 fiber were down 25% to 4,580 tons. Shipments during a comparable period in 1976 totaled 6,096 tons and the 1976 yearly total for Group 3 was 21,868 tons. Cassiar shipments through April 1977 were 53,628 tons, up 25% from a 1976 total of 42,844 tons. Major reasons for the decline in shipments in the first part of 1977 were: (1) the stagnant world economies; (2) cold weather in the United States in the first quarter; and (3) uncertainty caused by proposed environmental regulations and actions around the world. Replenished inventories of Group 4 fiber coupled with the slow recovery of economies around the world have softened the demand for this grade. Demand for Groups 5 and 6 fibers has remained strong. The built-up roofing and friction materials markets continue to consume large volumes of fiber. The sheet goods flooring market which has replaced the vinyl-asbestos floor tile market as the largest Group 7 market has remained soft, thus an excess of these grades still exists. The weakness of the Canadian dollar has caused some fiber suppliers to either raise prices or adjust prices to U.S. funds. Financial problems have forced the closing of the United Asbestos Midlothian Mine. On the positive side, Cassiar has recently an nounced it will continue to supply fiber from the Clinton Creek Mine through 1978 and possibly into 1979. Major Quebec producers are well underway with environmental programs that should enable them to meet current proposed regulations. The Quebec political situation continues to pose a question; how ever, it is becoming evident that Premier Levesque has major social and financial problems to deal with on a higher priority basis. The labor situation remains good. Canadian Johns-Manville has reached an agreement with its union; however, the agreement must be approved by the Anti-Inflation Board. C. Griffin and W. B. Monk. Concerning D-299 on Asbestos Yarn, to date only the review of Mr. Griffin had been received and his comments were discussed by the Group. Applicable Documents -- Add C-315 on Asbestos Tape and D-1571 on Asbestos Cloth. D-1061 on Asbestos Lap was not included since no yarns are being used in the product. Paragraph 3.4.1 -- In the first and second sentences, change the two words "piles" to "plies". Standard B-9 -- Since no one on the Committee was familiar with the document, it was decided that the Secretary of D13.14 should request a copy. Proper determination will be made upon receipt of the Standard. Paragraph 7.1.3 -- In line 1, change the word "this" to "the". Paragraph 9.1 -- On line 3, delete the words in parentheses "(without preconditioning)". Paragraph 9.2 -- Add "Preconditioning not necessary.". The reviews are to be completed by August 31, 1977. Since neither of the reviewers has issued his or her comments as yet, the Committee decided to suspend further analysis of the Standard until such comments, if any, are received. One exception was noted, i.e., Standard D-299 for Asbestos Yarn should be listed under Applicable Documents. 2) Standard Specification D-1571 for Woven Asbestos Cloth -- The question was raised as to whether or not treated weight cloth tolerance should be included. After discussion the Committee decided to not include such a tolerance. 3) American Textile Manufacturers Institute -- ATMI requested ATI representation at its metric conversion meetings. The ATI Execu tive Secretary will respond, suggesting representation through ASTM. 4) MEETING OF ASTM SUBCOMMITTEE D13.14 -- All members were urged to make a serious attempt to attend the meeting of ASTM Subcommit tee D13.14 on Asbestos Textiles, to be held Tuesday, October 25, 1977, beginning at 9:00 a.m. in the Lincoln Room, Doral Inn (formerly Belmont Plaza) in New York City. As its final item on the agenda, the Committee discussed the Hand book of Asbestos Textiles, 3rd Edition, a publication of ATI, Inc. Various revisions and additions required to up-date the Handbook were reviewed. However, because of other, more pressing financial burdens on the organization at present, the decision to proceed with a 4th Edition will be held in abeyance until the meeting in October. Devriese at the 1977 Spring General Meeting of the Asbestos Textile Insittute, Inc., held at the Capi tal Hilton Hotel, Washington, D.C., June 3, 1977 ATTENDANCE. Six members plus two guests were in attendance at the meeting of the Committee. DUST COUNT SURVEY. Dr. R. A. Kuntze was unable to attend the meet ing due to other business. However, he will endeavor to give his report on the dust count survey at the next gathering in October. REVISIONS TO CHRYSOTILE ASBESTOS TEST MANUAL, 3RD EDITION, 1974. Sixteen (16) pages of the current Manual have been revised and approved for publication at the May 12 meeting of the QAMA Techni cal Committee. The changes (whereunder nine (9) drawings) are on 8-1/2" x 11" sheets and are in possession of Mr. Devriese. QAMA and member companies indicate they will need 1,085 copies. The best procedure for printing and distribution will be established in due time. SAFETY. It was suggested that an introduction to safety in handl ing asbestos should be added to the Manual. The members of the Fiber Research & Testing Committee will send their suggestions to Chairman Devriese, after which they will be presented to the ATI Board of Governors and to QAMA members for approval. SUTER-WEBB vs. IMPROVED LENGTH MEASUREMENT MET' OD OF J.P. WRONSKI. A correlation between the two methods was performed at the labora tory of Asbestos Corporation Ltd. with encouraging results. Some members showed a strong interest in the test. Therefore a standard sample of one pound of fiber will be forwarded to Messrs. J. P. Wronski, D. E. Childers, C. E. Stiefken and H. R. A. Devriese. Mr. D. Barois B. of Asbestos Textil S.A. will also receive a sample for his participation. Asbestos Corporation will handle distribution of the samples, together with the detailed testing procedure as described by Mr. Wronski. LENGTH MEASUREMENT OF ASBESTOS FIBER. A brief explanation was given on another method of length measurement, after which a brief discussion took place. The theory of the technique will be for warded to Committee members for their comments. Kennedy at the 1977 Spring General Meet ing of the Asbestos Textile Institute, Inc., held at the Capital Hilton Hotel, Washington, D.C., June 3, 1977 DUST MEASUREMENT AND CONTROL SEMINAR -- JUNE 1, 1977 In presenting various methods of dust measurement and control, Mr. W. B. Reitze reviewed all of the methods used by Johns-Manville to measure dust. He stated that J-M had found the actual identifica tion of asbestos was not possible with a light microscope although it was possible, although difficult, with an electron microscope. 100% accuracy was not achievable by either method. After discussing several instruments used by Johns-Manville, Mr. Reitze recommended the Model Tyndallometer--TM Digital, manufac tured by Ernst Leitz Canada Ltd. It was a very informative Seminar and we are all very appreciative to have had such a competent and well versed speaker at our dispo sal . ENVIRONMENTAL COMMITTEE MEETING -- JUNE 3, 1977 Present: E. C. Bratt, D. E. Childers, R. A. Clifton (Guest), H. J. Corson, L. M. Eargle, F. Ize, W. H. Johnston, R. O. Moebius, J. D. Officer (Legal Counsel), H. H. Walter. The Committee reviewed what had transpired at the preceding Semi nar and discussed some of the findings pertaining to dust counting. Mr. Clifton relayed some of the findings of the National Bureau of Standards from its study of the fiber content of industrial talc, i.e. : "It is the opinion at NBS that, even under favorable circum stances (e.g., homogenous samples, easily identified fibers, etc.), the existing OSHA procedure is useful only for deter mining 'fiber' content and no 'asbestos' content." The above quoted opinion is part of NBS' findings of the afore-mentioned study done under contract for OSHA. The "OSHA procedure" to which the Bureau refers is the membrane filter method. The comment is part of a document titled "A Report on the Fiber Content ofEighty Industrial Talc Samples Obtained From, and Using the Procedures of, the Occupational Safety and Health Administration", prepared by the Staff of the Analytical Chemistry Division (P. D. LaFleur, Chief), Institute for Materials Research, NBS, May 1977. The member companies exchanged housekeeping and respiratory pro gram information after which they were asked to bring their ideas on energy as related to baghouses and air recycling to the next meeting. A call to order of the seventh meeting of the Board of Governors of Asbestos Textile Institute, Inc., was issued by Chairman Scanlan at 2:00 P.M., October 5, 1977. 2. MINUTES OF LAST STATED MEETING. Upon Chairman Scanlan calling ror a reading of the Minutes of the last stated meeting, a motion was made by Mr. Guffey to dispense with the reading thereof. The motion was seconded by Mr. Hay and so carried unanimously. 3_. FINANCIAL AUDITOR'S REPORTS. The six-page Report of Funds for the Fiscal Year ended August 31, 1977, (see Attachment I) was presented by Treasurer Corson. Total cash on hand at September 1, 1976, was $8,403.13. During the year cash receipts amounted to $16,571.59 for general purposes and $9,745.00 for the Corporate Litigation Defense Fund. Cash disbursements reached $14,835.38 for regular expenses, $491.00 for exchange items and $15,030.36 for corporate litigation, or a total for the year of $30,357.24. Taking into consideration the balance at the beginning of the year, plus all receipts, less all expenses and including assets and liabilities at year-end, the actual net worth of ATI INC. at August 31, 1977/ was $197.85. It was further noted that continuing sales of the Chrysotile Asbestos Test Manual, 3rd Edition, resulted in a net revenue of $520.06. Excluding extraordinary costs for corporate litigation, the corporation remained within budget, having allowed for general costs of $16,950.00 and expending $14,835.83. As reported by the Treasurer, the financial records had been audited by Dreslin and Company, Certified Public Accountants, and were found to have been in conformity with generally accepted accounting principles (see Attachment IT: 5 pages). It was moved by Mr. Bratt, seconded by Mr. Guffey, and so carried unanimously to accept the report as presented by the Treasurer. 4_. PROPOSED AND APPROVED 3UDGST. The Treasurer then proposed a budget for the Fiscal Year to August 31, 1978, which is appended hereto Attachment III. It was noted there were increases in the amounts proposed for legal expenses and the Secretary's travel lodging and meals to allow for anticipated extra costs for the June 1978 three-day meeting to be held in Quebec City. In addition, $300.00 was allowed for David A. Caruso, CPA, in view of the expansion of the quarterly production reports.. There was also a slight increase in office rent to accommodate normal rising costs for space. In answer to a query from Mr. Hay, Attorney Alcorn explained that the $4,100.00 budgeted for legal services would cover general counseling for such items as antitrust matters in a trade association context, counsel being present at all meetings, keeping in compliance with corporate law and various and sundry problems which must be discussed with the Secretary between meetings. The Board was advised that invoices for dues for the 1977/78 Fiscal Year were issued September 1, 1977, and that to date all dues were in except those from Asberit S.A., Hilados y Tejidos de Asbesto, TEA Industrial Products Ltd. and Lake Asbestos of Quebec Ltd. 6. CORPORATE LITIGATION DEFENSE FUND. The Treasurer then brought for discussion certain financial matters associated with the Corporate Litigation Defense Fund, stating that a proposal had been mailed by the Secretary on August 19, 1977, to the ten Regular Member companies represented on the 3oara Governors requesting their vote by mail to imposing a Special Assessment #B based on 125% of annual dues to cover current outstanding bills and projected expenses to April 1978. Nine of the ten firms responded, all casting aye votes. One company, Hilados y Tejidos de Asbesto, S.A., has not replied. An updated financial picture of the Fund was distributed to the Governors (see Attachment IV) which showed receipts, expenses and accounts receivable and payable as of August 31, 1977, and which left a deficit of $11,898.88. For purposes of discussion, to this deficit was added a projected accounts payable figure to April 31, 1978, of $10,550.00. RESIGNATION OF REGULAR MEMBER COMPANY. Chairman Scanlan read a letter dated August 26, 1977, from H. Iwata, Senior Managing Director of Asahi Asbestos Co. Ltd., Tokyo, Japan, tendering Asahi's resignation from membership in ATI INC. Cited as reason for the more WIT-006260 ATI-140 Page 4 - ATI INC. Board of Governors Meeting - 10/5/77 decision was that the company exports only small quantities of asbestos textiles to the United States and the volume does not justify the cost of annual dues and special assessments connected with the Institute. The Governors unanimously accepted the resignation, with regret. 8. HARMONIZED COMMODITY DESCRIPTION AND CODING SYSTEM. Mr. Scowcroft reported on what would be involved if ATI INC. were to participate in this System for use in the European Economic Community. After due consideration it was unanimously agreed by all present that ATI INC. should not contribute its services to the project. 9. ASBESTOS HEALTH HAZARDS COMPENSATION ACT. Attorney Alcorn advised that Repr. Fenwick and co-sponsor Repr. Beard introduced the Asbestos Health Hazards Compensation Act to the U.S. House of Representatives on August 2, 1977, as Bill No. HR 8689. The Bill has been referred to the House Committee on Education and Labor. Mr. Alcorn said there appears to be a significant, effort by the major companies and their legal counsel to find a legislative solution to the asbestos/health problem rather than through the courts. Interestingly enough, a recent U.S. Government study reported that one out of four workers throughout the country is estimated to have been exposed to a serious disease or deathcausing element in the workplace. This goes far beyond involving just the Asbestos Industry and it would not be surprising to see a whole new move toward Federal compensation for occupational hazards that lead to disease or death. 10. CARUSO REPORTS. As instructed by the Board at the previous meeting,, the Secretary polled the ten Regular Member companies to determine whether or not they were responsive to participating in the quarterly production reports which would show the bulk ofthe U.S. market for asbestos textiles. Nine companies responded, ail casting their aye vote by mail. The one company which did not reply was Rilaaos y Tejidos de Asbesto, S.A. This affirmative reaction was ratified by the Governors present. Therefore, begin ning with the Fourth Quarter of 1977 the nine participating - companies will be sent a form by David A. Caruso, CPA, which is to be filled in and returned to Mr. Caruso at the earliest possible date. Hopefully all returns will be in within 3-4 weeks following each quarter, after which Mr. Caruso will compile total figures for each asbestos textile product category and these totals will be issued, in writing, to each participating company. NOMINATION OF OFFICERS. It was moved by Mr. Bratt, seconded by Mr. Scowcroft, and so carried unanimously, to elect the following Officers to serve a second one-year term to October 1978: President--Michael J. Scanlan of Amatex Corporation; and Vice President and Treasurer--Harland J. Corson, Jr., of T3A Industrial Products Ltd. The following gentlemen will fulfill the second year of two-year terms as Committee Chairmen: Techni cal Committee--Alton R. Morrill of Canadian Johns-Manville Co. Ltd.; Environmental Committee--Claude A. Kennedy of RaybestosManhattan, Inc.; and Fiber Research and Testing Committee--Hermann R. A. Devriese of Asbestos Corporation Ltd. 12. BARRY I. CASTLEMAN. Following a directive from the Governors at the June 1977 meeting, issued in reply to a request from Mr. Barry I. Castleman, an environmental consultant, the Secretary wrote Mr. Castleman inviting him to make a ten-minute presentation to the'Board on October 5, 1977, about his concern over the rising asbestos textile imports into the United States and the problem of competition from "unregulating" countries. Mr. Castleman con tacted the Secretary advising he was not connected with any company and did, not have sufficient funds to finance airfare and other expenses involved with attending the Board meeting in Florida. Ke asked if ATI INC. would be willing to underwrite part or all of the costs. After consultation with Chairman Scanlan it was agreed that ATI INC. could not undertake such an expense but that the offer to speak to the Board was still open. Mr. Castleman was so advised but did not attend the meeting. 13. FUTURE MEETING SITES AND DATES. Because of increasing costs of corporate litigation and in an effort to hold down controllable expenses for the time being, it was moved by Mr. Guffey, seconded by Mr. Bratt, and so carried to cancel the General Meeting which was to be held February 2-3, 1978, in Atlanta and schedule only a Board of Governors meeting in New York City on Thursday, February 2, 1978. The meeting will begin at 10:30 A.M. at the law offices of Caawalader, Wickersham & Taft, One Wall Street, New York City. The next two General Meetings are confirmed as follows: June 7-9, 1978, at Le Chateau Frontenac, Quebec City, hosted by the mining member companies; October 4-6, 1978, at Kiawah Island Inn, Charleston, South Carolina. ' Discussions of the three meetings in 1979 were tabled and will again be brought before the Board at the February 1978 meeting. COMMITTEE REPORTS AND DISCUSSIONS. a) Technical .-- Acting Chairman Wm. Maaskant of Amatex Corporation reported that new Precision and Accuracy requirements for asbestos textile specifications of the American Society for Testing -and Materials have made it necessary for the Committee to work toward revising certain standards, particularly D299 and D375 on yarn and roving. The group will meet as ASTM Subcommittee D13.14 on Asbestos Textiles in New York City on October 25, 1977. Mr. Maaskant asked all companies to sanction attendance at the meeting. Concerning the Handbook of Asbestos Textiles, 3rd Edition, Committee Chairman Morrill has studied the current edition and found there is reference to the fact that all ASTM standards are subject.to revision and that the reader should consult the latest Book of ASTM Standards for up-to-date data. Therefore, it is still okay to distribute the Handbooks, as now written. The Secretary alerted Mr. Maaskant to the formation of an ASTM committee to write standards for chemical protective clothing. After discussion it was decided this probably would not be concerned with asbestos-containing textiles and, therefore, ATI INC. should not participate in the new endeavor. b) Environmental -- Chairman C. A. Kennedy of RaybestosManhattan, Inc., reported on plans for the Committee to discuss several industrial environmental matters including what is being done on recycling of air' for energy conservation and a yet-to-be published NIOSH Report dated May 1977 titled "Review and Evaluation of Analytical Methods for Environmental Studies of Fibrous Particulate Exposures". c) Fiber Research and Testing -- Since the Chairman had not arrived as yet, no report was presented to the Governors. How ever, the Committee will meet the following morning, as scheduled. 15. ADJOURNMENT. There being no further business to be brought before the Board of Governors, it was moved by Mr. Bratt, seconded by Mr. Hay, and unanimously approved to adjourn the meeting at 5:30 P.M. The 1977 Annual General Meeting of Asbestos Textile Institute# Inc., was called to order by President Scanlan at 9:00 A.M. # October 7# 1977# at the Ponte Vedra Club# Ponte Vedra Beach# Florida. 2. INTRODUCTIONS AND OFFICIAL WELCOME. President Scanlan welcomed all in attendance# asking each attendee to rise and give his or her name and business affiliation. READING OF MINUTES, Upon calling for a reading of the Min utes of the last stated meeting# it was moved by Mr. Leclerc# seconded by Mr. Stiefken# and unanimously approved, to dispense with the reading thereof. 4. FINANCIAL REPORT. A report on the financial posture of ATI INC. for the Fiscal Year ended August 31# 1977# was presented by Treasurer Corson. Total cash on hand at September 1# 1976, was $8,403.13; receipts totaled $26,316.59; disbursements reached $30,357.24; total assets were $5,217.34 and total liabilities amounted to $5,019.49 -- leaving an actual net worth at year-end of $197.85. Sales of the Chrysotile Asbestos Test Manual# 3rd edition, resulted in a net revenue of $520.06. Excluding exchange items and extraordinary corporate litigation expenses, disburse ments resulted in $14,835,88 against a budgeted expense figure for the year of $16,950.00. Treasurer Corson fur ther advised that the financial records had been audited by Dreslin and Company, Certified Public Accountants, and had been found to be in order. . A report on the Corporate Litigation Defense Fund was given by the Treasurer. Upon issuance of Special Assessment #A, the Fund was established as of February 3, 1977. Receipts from the assessment and from voluntary contributions amounted to $9,745.00; total expenses were $15,030.36, accounts receivable totaled $661.79 and accounts payable reached $7,275.31, result ing in an actual net loss at August 31, 1977, of $11,898.88. Adding a projected accounts payable figure to April 1978 of $10,550.00 indicates an expected deficit on April 31, 1978, of $22,448.88. Because of this financial situation, the Board of Governors approved that a Special Assessment #3 be imposed on the Regular Member companies and that the Associate Member com panies be asked to consider voluntary contributions -- based on 140% of annual dues. The cooperation of all member companies should permit ATI INC. to return to a sound financial standing. The one--page report on the Corporate Litigation Defense Fund is appended hereto as Attachment II. Treasurer Corson then presented the regular income/expense Budget for F/V 1977-78 which shows an anticipated receipts figure of $16,150,00 and expected expenditures of $15,575.00 -- which leaves $475.00 as a reserve amount. The new one-page Budget is appended hereto as Attachment III. The above-mentioned report of Funds as of August 31, 1977, the report on the Corporate Litigation Defense Fund as of the same date and the Budget for F/Y 1977-78 had been approved by the Board of Governors on October 5, 1977. There being no ques tions from the general membership, the reports were accepted as presented. J>. GOVERNMENT ISSUES. In rendering an impromptu speech to the members, Mr. Clifton stated that the U.S. Occupational Safety and Health Administration is hesitant to schedule hearings on its proposal to reduce the asbestos exposure limitation to 0.5 fibers per cubic centimeter of air. There are two significant reasons for this reluctance. The method recommended by OSHA to monitor asbestos in the workplace is in ill repute among recognized technological authorities such as the U.S. National Bureau of Standards, the U.S. National Institute for Occupational Safety and Health and Irving J. Selikoff, M.D. These experts are saying that the Membrane Filter Method cannot identify asbestos., espec ially in situations whore other matorials arc present. In PRODUCED JM - 83 more.............. MS 006875 MT-006280 ATI-140 Page 4 - Minutes of ATI INC. 1977 Annual General Meeting 10/7/77 addition, it appears highly unlikely that OSHA will lower the limit from the current 2f/cc because it does not have any technologically-acceptable reasons to do so. Its proposal to lower the limit to half a fiber is supposedly based on new medical evidence but as pointed out to OSHA by the Asbestos Information Association/North America, none of the new medical evidence is based on dose-response relationship. Mr. Clifton also gave a brief review of the Rockville quarry situation in Maryland, stating that the State refused to permit the newspapers and en vironmentalists to stampede it into making a quick decision, realizing the statements being issued were sensational and emotional rather than based on sound judgment and scientific knowledge. The State, therefore, decided there is no imminent hazard. 6. FIBER PRODUCERS REPORT. Mr. Farrell presented a report on behalf of the fiber-producing member companies of ATI INC. dis cussing the current demand for spinning fiber and for Groups 4-7. He projected that over the long term the developing nations of the world will support a good level of demand for asbestos. The entire report is appended hereto as Attachment IV. 1_, TECHNICAL COMMITTEE REPORT. Committee Member Hawkins review ed the work being done on the various ASTM specifications and urged support from the membership by way of attendance at the meeting of ASTM Subcommittee D13.14 to be held October 25, 1977, in New York City. The entire report is appended hereto as Attachment V. 8. FIBER RESEARCH AND TESTING COMMITTEE REPORT. As reviewed by Mr. Devriese, the Committee discussed dust control survey moni toring equipment, revisions to the Chrysotile Asbestos Test Manual, 3rd edition, and length measurement of asbestos fiber. There was also an appeal for more Committee representation by manufacturing member companies. The latter was proposed as a means by which the Committee could learn of special manufactur ing problems and perhaps be of assistance toward discovering solutions to those problems. The Committee further requested the Board of Governors to consider rescheduling the time the Fiber Research and Testing Committee holds its meetings, to per mit attendance at meetings of other Committees. The entire report is appended hereto as Attachment VI. 9. ENVIRONMENTAL COMMITTEE REPORT. Committee Chairman Kennedy reported that the following topics and literature were discussed by the group: energy as it relates to asbestos textile manufac turing plants (recycling of air, baghouse efficiencies, etc.); ppm M -m MS 006876 more IV7T-006281 ATI-140 Page 5 - Minutes of ATI INC. 1977 Annual General Meeting 10/7/77 baghouses and bag cleaning; new ruling in California concerning the registration of asbestos-containing products; the yetunnumbered NIOSH report titled "Review and Evaluation of Analyti-. cal Methods for Environmental Studies of Fibrous Particulate Exposures"; NIOSH Publication #77-169 dated December 1976 which serves as documentation for the 0.1 proposal and the 0.5 coiling concentration; and the U.S. Dureau of Mines' Mineral Commodity Profiles which cover the availability of minerals throughout the world, including Rhodesia and the USSR. The entire report is appended hereto as Attachment VII. 10. TRIAL COUNSEL REPORT. Attorney Alcorn reviewed the history of litigation as it has affected the Asbestos Textile Institute (unincorporated association; now dissolved) and the Asbestos Textile Institute, Inc. (incorporated August 27, 1975). The unincorporated association became involved in the Tyler Litigation (Texas) when services of process were received January 18, 1974, in the Yandle case and February 5, 1974, in the Kay case. On August 19, 1976, the unincorporated association receiv ed a show cause order from the Judicial Panel on Multidistrict Litigation which sought to consolidate certain then-existent asbestos-related lawsuits. On April 7, 1977, the Panel voted against such consolidation. Voluntary dismissal of the unincor porated association from the Tyler Litigation was received by ATI's local counsel July 6, 1977, and the Association was dis solved July 29, 1977. Shortly thereafter the Tyler Litigation was settled for $13-million, of which the U.S. Government was to pay $2.5-million. Over 400 plaintiffs had issued complaints in that Litigation. The first suit in which ATI INC. (the corporation) was named a defendant was the Shoup case in Detroit, Michigan. The corpor ation received the service of process March 5, 1976, and volun tary dismissal was finalized May 18, 1976. Concerning the Philadelphia Litigation (Pennsylvania), the corporation received notices that it had been sued in the Ferris complaint on July 19, 1976; the Gerace complaint on September 14, 1976; the Richards and Talarico complaints on October 21, 1976; and the Corea complaint on November 3, 1976. Motions for Leaves to Discontinue v/ero received by the corporation on August 15,1976, in the Gcracc, Richards, Talarico and Corea casco. Hearings on these Motions are to be held. MIS 006877 Finally, the corporation has been nonsuited in the five cases in Virginia in which it had been a defendant, i.e., ser vice in the Glover case received October 5, 1976, and nonsuited June 22, 1977; service in the Qnan case received October 14, 1975, and nonsuited March 30, 1977; service in the Walker case PRODUCED more............... Still in effect, insofar as the corporation is concerned, are the Ferris case in Philadelphia and the Moore lav/suit filed in Chester, Pennsylvania. Service of Process for the Moore complaint was received by the corporation February 15, 1977. Mr. Alcorn stated that because of his representing ATI, the corporation, and others, he has dealt with major plaintiffs lawyers across the country who have sued the Institute, the cor poration and several companies. In addition, past minutes of the Institute and the corporation were subpoenaed, after redaction because of attorney-client privilege. Now that many attorneys are aware of what the Institute was and what the corporation is, Mr. Alcorn does not expect the corporation to be sued in any major asbestos litigation in the future. 11. NEW OFFICERS FOR 1977/78. Mr. Scowcroft reported that the following officers had been elected by the Board of Governors to serve second one-year terms to October 1978: President-- M. J. Scanlan of Amatex Corporation; Vice President and Treasurer --H. J. Corson, Jr., of TBA Industrial Products Ltd. Also, the following members will fulfill the second year of two-year terms as Committee Chairmen: Technical--A. R. Morrill of Canadian JohnsManville Co. Ltd.; Environmental--C. A. There had been some past discussion the booklet was out-of-date in certain instances, particularly because the ASTM standards and specifications re ferred therein had been revised several times since the publica tion of the 3rd edition of the Handbook. However, it was deter mined the Handbook is still valuable and that it does mention that the latest revisions of ASTM standards and specifications are available from ASTM. 13. RESIGNATION. President Scanlan regrettably advised that Asahi Asbestos Co. Ltd. had tendered its resignation from member ship in ATI INC., citing as its reason that sales in the U.S. market are insufficient to balance the cost of dnae and other assessments. In an effort to re duce expenses and pool as much financial effort as possible toward meeting extraordinary costs of corporate litigation. President Scanlan reported the Board unanimously elected to can cel the General Winter Meeting which was to be held February 2-3, 1978, in Atlanta, Georgia, and to hold only a meeting of the Board of Governors in New York City on February 2. 15. 1978 SPRING GENERAL MEETING. On behalf of Mr. Walter Smith, President Scanlan advised that from June 7-9, 1978, the Canadian mining member companies will host the ATI INC. 1978 Spring Meet ing at Le Chateau Frontenac in Quebec City. The meeting will begin on Wednesday afternoon with a meeting of the Board of Governors. The host companies are in the midst of planning recep tions and meals at the hotel and at several of the smaller, more intimate French restuarants in the area. Options on Thursday will be tours through the mines and mills in Thetford Mines or tours of old Quebec guided by female students from Laval Univer sity, who speak fluent French and English. Well in advance of the meeting, a mailing will go out to the members giving hotel, flight and other pertinent information. The meeting will close with Committee and General Meetings on Friday morning. 16. ADJOURNMENT. A. Farrell at the 1977 Annual General Meeting of Asbestos Textile Institute, Inc., held October 7, 1977, at the Ponte Vedra Club, Ponte Vedra Beach, Florida. Mr. Farrell is Director of Sales for Lake Asbestos of Quebec Ltd. We reported at the February 1977 meeting that spinning and Group 7 fibers were available but that fiber Groups 4, 5 and 6 were in strong demand. As of September 1977 the demand for spinning fiber has softened further. As a result, one Canadian supplier reduced some spin ning fiber prices on July 1, 1977, and African fiber is now bade under boycott in the United States. Demand for Groups 4, 5 and 6 fibers has also softened and these grades are now available, as is Group 7. The reduced demand for fiber is due to poor world economic conditions and in part to environmental problems. In my opinion, however, over the long term, good demand for asbestos will continue, supported by the developing nations of the world. The 1976 asbestos fiber exports for all of Canada as supplied by Statistics Canada, with a detailed breakdown for Group 3 fiber, are shown on the following table. The U.S. continued to be the largest consumer, followed by the United Kingdom. ATTENDANCE: Five members plus one guest were in attendance at the meeting of the Committee. DUST COUNT SURVEY: A report on the dust count survey monitoring equipment prepared by Dr. R. A, Kuntze has been distributed to the members of the Committee. SAFETY: During the QAMA Technical Committee meeting- in September the members had suggested to add the following wording to the Chrysotile Asbestos Test Manual, 3rd Edition: "CAUTION - contains asbestos fibers. Avoid creating dust. Breathing asbestos dust may cause serious bodily harm." This wording v/as accepted, in principle, by the ATI Fiber Research and Testing Committee members but it vas suggested to add: "Adequate ventilation should be provided". This caution labeling is apparently acceptable to OSHA and will be verified by W. B. Alcorn, Jr., ATI Legal Counsel. The caution introduction will then be re-discussed with QAMA and ATI members during the next meetings and will be brought before the Board of Governors for approval. REVISIONS TO THE CHRYSOTILE ASBESTOS TEST MANUAL, 3RD EDITION, 1974: Copies of the revised testing sheets of the manual v/ill be presented to various printers for price quotations. FIBER RESEARCH AND TESTING COMMITTEE MEMBERSHIP: Again it was suggested that manufacturers take part in the Committee for different reasons -- a) We suggest that the manufacturers bring up technical fiber problems so that the Committee can look into the problems and, with the cooperation of all, try to come up with solutions, which is the main reason for the Committee. b) As we are in the process of introducing new testing proce dures, such as the above-mentioned fiber length measurement, it is necessary and of interest to all to have manufacturers active on this Committee. COMMITTEE MEETINGS: As the members of the Committee are sometimes interested in attending other committee sessions, it is suggested to look into a new method of scheduling the meetings at different time periods so that members interested may have the opportun ity to attend these sessions. Clifton Baghouse efficiencies and energy and energy savings as related to recycling air in the workplace were discussed. A poll . was taken as to which members are presently recycling air. The results were that one company is recycling; four companies are not permitted by local and state law; and one company is going to begin recycling air, with continuous monitoring. It was decided that a clearly-defined federal law concerning this subject is needed before any definite plans can be made. The following NIOSH report was reviewed and discussed; Review and Evaluation of Analytical Methods for Environmental Studies of Fibrous Particulate Exposures, May 1977, Ralph D. Zui.twalde and John M. Dement. Mr. Walter reported on DHEW (NIOSH) Publication No. 77-169, dated December 1976, concerning the NIOSH proposal to OSHA for a 0.1 f/cc standard. A discussion followed. Mr. Clifton presented the Committee with a copy of the bulletin titled ASBESTOS/1977 MCP-6 Mineral Commodity Profiles. A discussion followed. There was also discussion on filter bag cleaning after which it was decided the filter bags should be tested as to initial specifications and be replaced if 80% of the initial specifi cation criteria was not met. It was agreed cleaning was not helpful or necessary.
