The EPA determined that the rule is deficient in three respects but that conditional approval of the revision will not interfere with continued attainment of the NAAQS in the area. The revision consists of a best available retrofit technology (BART) determination and emission limits for sulfur dioxide, nitrogen oxides, and particulate matter for Unit 4 at the Danskammer Generating Station in Newburgh. The revision also restricts Unit 4 to combusting only natural gas. In addition, the rule withdraws identical emission limits in the Aug. 28, 2012, federal implementation plan (77 FR 51915) that addressed BART for Danskammer Unit 4. Notice of the U.S. Army Corps of Engineers supplements a March 4, 2016, notice of intent (81 FR 11529) to prepare a joint environmental impact statement/environmental impact report regarding the San Francisco Bay to Stockton Navigation Improvement Study. The original study would have evaluated the efficiency of the movement of goods along the existing deep-draft navigation route extending from the West Richmond Channel to the Stockton Deep Water Ship Channel. The agency now proposes a reduced scope and project footprint that includes a study area extending from Central San Francisco Bay to Avon only. The agency also proposes to evaluate incremental deepening only to a maximum depth of 38 feet mean lower low water. The draft EIS/EIR is expected to be issued in summer 2018. Notice of FERC announces the availability of the environmental review schedule for the Midcontinent Supply Header Interstate Pipeline Project in Bryan, Canadian, Carter, Garvin, Grady, Johnson, Kingfisher, and Stephens counties in Oklahoma. The project, proposed by Midship Pipeline Co., of Houston, includes construction and operation of a new 199.4-mile natural gas pipeline system, three mainline compressor stations, a 20.3 mile lateral pipeline and a 13.6 mile lateral pipeline, one lateral booster station, metering and regulating stations, and appurtenant facilities with a total system capacity of 1,440 million cubic feet/day. The system would provide firm transportation capacity from the South Central Oklahoma Oil Province and the Sooner Trend Anadarko Basin Canadian and Kingfisher plays to existing pipelines near Bennington, Okla. Final rule of the EPA extends the time-limited tolerance for residues of the insecticide clothianidin and its metabolites in or on citrus fruit, group 10-10, at 0.07 parts per million (ppm) for an additional three-year period for use in the control of the Asian citrus psyllid in Florida and Texas. The rule also extends time-limited tolerances for residues of the insecticide sulfoxaflor and its metabolites in or on sorghum forage at 0.4 ppm, sorghum grain at 0.3 ppm, and sorghum stover at 0.9 ppm for an additional three-year period for control of the sugarcane aphid in several states. PESTICIDES Pesticide Tolerances/Ethofumesate PESTICIDES
Final rule of the EPA establishes and eliminates tolerances for residues of the herbicide ethofumesate in or on sugar beet molasses and roots. The rule is issued in response to a petition filed by Interregional Research Project Number 4, of Princeton, N.J. The current action establishes tolerances that differ from what the petitioner requested due to the agency's determination that an increased tolerance is not needed because the commodity is no longer a significant livestock feed item or a recognized human food. PESTICIDES Pesticide Tolerances/Prometryn PESTICIDES
Final rule of the EPA establishes tolerances for residues of the herbicide prometryn in or on multiple commodities. The rule is issued in response to a petition filed by Interregional Research Project Number 4, of Princeton, N.J. The rule also modifies tolerance levels to reflect the correct number of significant figures and removes the tolerance for residues of prometryn in/on sesame oil at 0.12 parts per million because the tolerance is not necessary. In addition, the rule revises the description of "florence fennel" to "fennel, florence, fresh leaves and stalk." The rule is effective Dec. 4, 2017. PESTICIDES Pesticide Tolerances/Quinclorac PESTICIDES
Final rule of the EPA establishes tolerances for residues of the herbicide quinclorac and its methyl ester metabolite in or on the bushberry subgroup 13-07B, the caneberry subgroup 13-07A, and asparagus at 0.08 parts per million. The rule is issued in response to a petition filed by Interregional Research Project Number 4, of Princeton, N.J. The current action increases the levels of tolerances that were requested by the petitioner because the residue values from the submitted field trial data did not include the residue values of methyl ester metabolite. The rule also revises the definition of "bushberry subgroup 13-07B, except lowbush blueberry" to "bushberry subgroup 13-07B" because the lowbush blueberry tolerance is covered under another subgroup.
