Final rule of the Department of Agriculture, Weights and Measures Services Division, amends regulations under R3-7-101 through -1013 (nonconsecutive) and repeals regulations under R3-7706 and -709 to update division standards, including requirements for motor fuels and petroleum products and for gasoline vapor control. The rule reduces classroom and examination requirements for vapor recovery testers to once every three years. The rule also updates fuelrelated standards for consumer postings, fuel quality requirements, and dispenser equipment requirements. In addition, the rule revises requirements for production, supply, and blending of biofuels and removes the deadline for submitting alternate decommissioning plans to allow flexibility to gas stations required to remove Stage II vapor recovery equipment by Sept. 30, 2018. Finally, the rule updates citations and other requirements to reflect the transfer of the Department of Weights and Measures to the Department of Agriculture. The rule is effective Oct. 2, 2017. 1180 to require petroleum refineries that have the permitted capacity to process more than 10,000 barrels of crude oil per day to install and operate continuous, real-time fenceline and community air monitoring systems. The rule requires refinery operators to submit written plans for establishing and operating such systems, including specifying equipment to be used, the method for disseminating data to the public, and audit procedures. The rule also requires refinery operators to notify the district of downtime for planned maintenance and unplanned equipment failures that impact monitoring data. In addition, the rule requires refinery operators to maintain monitoring records for five years and exempts refinery operators that comply with a costrecoverable community air monitoring agreement. Notice of the San Diego Regional Water Quality Control Board seeks comments on the proposed approval of an amendment (R9-2017-0015) to the water quality control plan for the San Diego Basin. The amendment incorporates site-specific water effect ratios for copper and zinc of 6.998 and 1.711, respectively, into the water quality objectives and total maximum daily loads for dissolved metals in Chollas Creek. The board will publish an agenda for the meeting where a resolution to adopt the basin plan amendment will be considered. Comments are due Oct. 18, 2017. Notice of the Central Valley Regional Water Quality Control Board announces a resolution (R52017-0088) amending the water quality control plan for the Sacramento and San Joaquin river basins and the Tulare Lake Basin. The amendments establish a regionwide municipal and domestic supply (MUN) beneficial use evaluation process in agriculturally dominated surface water bodies. The amendments also establish implementation and monitoring requirements when the MUN beneficial use is modified in agriculturally dominated surface water bodies. In addition, the amendments establish a limited MUN beneficial use applicable to agriculturally dominated water bodies with inherent limiting conditions. Finally, the amendments also remove the MUN beneficial use from 231 constructed or modified agriculturally dominated surface water bodies within the San Joaquin River Basin. Proposed rule of the Environmental Quality Board amends regulations under 25 PAC 109.1 through .1307 (nonconsecutive) and adopts regulations under 25 PAC 109.1401 through .1413 concerning safe drinking water. The rule clarifies source water assessment and protection program requirements; updates treatment technique requirements for pathogens; and establishes requirements for filtration plant alarms, shutdown capabilities, and auxiliary power. The rule also requires certain public water systems to consult with the department prior to making significant changes to disinfection practices, updates submission requirements for new source permit applications, and updates design and construction standards for certain public water systems. In addition, the rule updates requirements for community water systems, increases permit fees and establishes annual fees, and addresses corrective action. Finally, the rule establishes the regulatory basis for issuing general permits; clarifies that noncommunity water systems require a permit or approval from the Department of Environmental Protection prior to construction and operation; and updates monitoring, reporting, and tracking requirements for back-up sources of supply.
