(the "Site" or "Facility"), located at 10459 S. Muskegon, Chicago, Illinois, at 09:15 AM (CST) on 7/28/2022 for an unannounced inspection. Inspectors presented their credentials to Rusty Napier and Tom Byrne and informed the Facility that this was an EPA Region 5 inspection to determine compliance with the Clean Water Act (CWA) and the National Pollutant Discharge Elimination System (NPDES) permit program. The inspection was conducted under the authority in Section 308 of the CWA. The table above identifies the attendees that participated in the inspection. This report is based on information supplied by Facility representatives, observations made by the Region 5 inspectors, and records and reports maintained by the Facility Region 5. These include the following: direct observations made by the Region 5 inspectors, photographs taken by Region 5 inspectors, physical evidence collected by Region 5 inspectors, measurements taken by Region 5 inspectors, verbal or written statements made or supplied by Facility representatives during or subsequent to the on-site inspection, and materials, processes, data, photographs, or documents shown, demonstrated, or submitted to the Region 5 inspectors by Facility representatives during or subsequent to the on-site inspection. In addition, information gathered prior to or subsequent to the inspection from a review of U.S. EPA, State, and public records may be included in this report. Facility/Site Description Region 5 Lead Inspector confirmed the following facility information: The Facility is a starch and phosphate distributer and a contract packaging facility. The Facility has been operating at the 10459 S. Muskegon location for approximately 2 years. The Facility is not currently covered under an NPDES Permit, but the EPA was informed during this inspection that an application for an Industrial User (IU) Permit has been submitted to the Metropolitan Water Reclamation of Greater Chicago (MWRD). Along with the permit application, the Facility is also currently working with consultants from Gabriel Environmental to develop a Stormwater Pollution Prevention Plan (SWPPP). However, the permit application to MWRD states that the Facility does not currently have plans to adjust their categorical pretreatment limits with a CWF. 40 CFR 403.6 outlines the method for calculating alternative pollutant limits at industrial facilities where regulated process effluent is mixed with other wastewaters prior to treatment. Facility composite sampler set up inside to take 24-hour samples. Thermometer not present within sampler. Sampling and holding requirements under 40 CFR Part 136 requires certain parameters to be preserved under a certain temperature. A thermometer is needed to confirm the temperature. Chemical storage within the Facility is located near a drain leading to the Facility settling tank. No secondary containment was present to prevent spills or other chemical releases from entering the Facilities treatment system. Truck loading area in back South side of Facility contained some soy waste on the ground. Food waste has potential to enter the stormwater system at the Facility, bypassing the treatment systems. During the closing conference, the Lead Inspector discussed the observations and Areas of Concern identified during the inspection. Observations and Areas of Concern have not yet been evaluated for a formal compliance determination.
