The rule, which is part of a consolidation of hazardous waste regulations, adds filing, modification, and annual registration fees for certain applicants and permitholders. The rule also provides that the agency will refund certain fees if it fails to provide a written determination of receipt of a generator's request to treat hazardous waste on-site within 60 days. EPA, 1:17-cv-01906 ED_001523_00000747-00001 --Administrative Register of Kentucky (08/01/2017) Regulatory Update RADIATION TENORM Radiation Protection Standards in Oil and G Kentucky RADIATION elopment Proposed rule of the Cabinet for Health and Family Services, Department of Public Health, adopts regulations under 902 KAR 100:180 to establish radiation protection standards for the possession, use, transport, transfer, and disposal of technologically enhanced naturally occurring radioactive material (TENORM) concerning oil and gas development. The rule specifies applicability to activities related to TENORM with an activity concentration greater than 5 picocuries per gram of combined radium-226 and radium-228. The rule also establishes requirements for sample collection and analysis, transporting TENORM waste for management or disposal, recordkeeping, and the disposal of waste. In addition, the rule addresses requirements for material or real property containing TENORM, worker training and safety, violations, exemptions, and definitions. A hearing is scheduled for Aug. 21, 2017, in Frankfort. Comments are due Aug. 31, 2017.
