The rule aligns provisions with recent updates to the U.S. EPA's Refinery Sector Rule regarding flares, including new prohibitions on smoking flare events. The rule also requires facilities to prepare a scoping document on the feasibility of eliminating all planned flaring events. In addition, the rule removes the $4 million annual cap on mitigation fees that facilities may pay for flaring, updates the volatile organic compounds emission factor based on the U.S. EPA's updated AP-42 guidance, and updates and clarifies reporting requirements for facilities. Notice of the South Coast Air Quality Management District announces a hearing on the supplemental reasonably available control measures/reasonably available control technology (RACM/RACT) analysis for the 2006 24-hour fine particulate matter (PM-2.5) and 2008 8-hour ozone national ambient air quality standards. The supplemental RACM/RACT analysis is issued in response to an April 14, 2016, final rule of the U.S. EPA that disapproved the RACM/RACT for the 2006 PM-2.5 standard and related reasonable further progress state implementation plan revisions based on a finding that the 2010 Regional Clean Air Incentives Market (RECLAIM) program does not meet the RACM/RACT requirement for certain sources of emissions. AIR Particulate Emissions from Soils with Toxic Air Contaminants California Regions AIR
Notice of the South Coast Air Quality Management District announces a hearing on a proposed rule to adopt regulations under Rule 1466 to establish requirements for the control of particulate matter emissions from soils with toxic air contaminants resulting from earth-moving activities at cleanup sites. The rule establishes an ambient dust limit and dust control measures at cleanup sites and requires notification when cleanup operations begin and when emission limits are exceeded. The rule also requires signage at sites, sets forth additional requirements for sites near schools and early education centers, and permits the use of alternative dust control measures. The rule applies to earth-moving activities at sites that have been designated as cleanup sites by the U.S. EPA, Department of Toxic Substances Control, State Water Resources Control Board or Regional Water Quality Control Board or sites for which the district has information that the soil contains levels of certain toxic air contaminants that exceed DTSC soil clean-up thresholds. Notice of the Bay Area Air Quality Management District announces revisions to and an additional hearing on a proposed rule to adopt regulations under Rule 12-16 regarding petroleum refining facilitywide emission limits. The initial proposal would have limited emissions of greenhouse gases (GHGs), particulate matter (PM-2.5 and PM-10), nitrogen oxides, and sulfur dioxide from petroleum refineries and associated facilities by setting a maximum annual emission rate based on emissions reported during a 2010-2014 baseline period, plus a 7 percent additional allowance. The revised proposed rule establishes a cap on GHG emissions from petroleum refineries and associated facilities. The notice specifies that the district will develop rulemaking to reduce emissions of criteria pollutants, including PM emissions, from refineries by 20 percent by 2020 at a later date. Notice of the Department of Environmental Quality, Air Pollution Control Board, announces a proposed revision to the state implementation plan regarding amendments to regulations under 9 VAC 5-10 regarding general definitions. The revision updates the definition of volatile organic compound (VOC) to align with the current EPA definition by removing the recordkeeping, emissions reporting, photochemical dispersion modeling, and inventory requirements related to the use of t-butyl acetate as a VOC. The revision also adds 1,1,2,2-tetrafluoro-1 -ethane to the list of substances not considered to be VOCs. The amendments were issued as fast-track rules on Oct. 31, 2016, and April 13, 2017. Proposed rule of the Department of Mines, Minerals and Energy amends regulations under 4 VAC 25-160-30, -40 and -110 regarding the Gas and Oil Board. The rule requires documents submitted to the board or the department be sent electronically and allows for additional methods of communication when certain notifications are required to be sent to other resource owners. The rule also specifies that when the location of a prospective gas or oil well is required to be published in a newspaper, the notice can include either a map or a description of the location. In addition, the rule clarifies that an affidavit must be submitted to the board to release a previous unit operator from responsibility as the unit operator. The rule, which is proposed for fast-track processing, is proposed to be effective July 27, 2017. Comments are due July 12, 2017. Proposed rule of the Department of Environmental Protection, Division of Water and Waste Management, amends regulations under 33 WVCSR 20 regarding the hazardous waste management system to incorporate by reference July 1, 2017, federal standards under 40 CFR 260 through 279. The rule allows generators of episodic waste to avoid higher generator status requirements if the episodic waste continues to be properly managed. The rule also adds emergency management communication requirements and allows very small-quantity generators to send hazardous waste to a large-quantity generator if both are under the control of the same person. In addition, the rule revises the definition of solid waste to clarify recycling standards for hazardous secondary materials. A hearing is scheduled for July 6, 2017, in Charleston. HAZARDOUS WASTE MANAGEMENT Underground Storage Tanks West Virginia HAZARDOUS WASTE MANAGEMENT
Proposed rule of the Department of Environmental Protection, Division of Water and Waste Management, amends regulations under 33 WVCSR 30 regarding underground storage tanks (USTs). The rule incorporates by reference July 15, 2015, federal standards under 40 CFR 280 regarding corrective action requirements and technical standards for owners and operators of USTs. The rule also adds provisions concerning adjustment of certification fees and updates certification and training requirements for operators and personnel.
